As short as possible, as much as necessary
We believe that general terms and conditions do not need to be overly extensive—provided that the interaction between buyer and seller is based on good faith. In this regard, a few basic principles are entirely sufficient, namely:
1. A Contract is considered finalized as soon as both parties reach an unambiguous agreement, either verbally or in writing.
2. The reported Prices get along including Swiss value-added tax and without a frame, unless otherwise expressly stated. Any costs for pickup, delivery, shipping, transportation, insurance, and other expenses will be quoted on a case-by-case basis.
3. The Sale of inventory We expressly reserve the right to do so; with approximately 3,000 posters, it is possible that a recently completed sale may not be noted on placart.ch or removed from the site within a day.
4. Before a work is not paid in full remains the property of Placart GmbH. As a general rule, no works that have not yet been paid for will be handed over or shipped.
5. We guarantee authenticity the works we offer; we do not sell reproductions, we do not sell reissues, and we do not sell imitations either. Any exceptions are clearly indicated.
This guarantee of authenticity is provided to the best of our knowledge and belief. However, it is limited to one year from the date of purchase, provided that no information was available prior to the date of purchase that would make it highly plausible to conclude that the purchased work is inauthentic—information that the seller should have been aware of or could have obtained with relatively little effort.
The reason for this—minor—limitation on the guarantee of authenticity is that, particularly in the art world and in the case of works created in some instances over 100 years ago, information that was previously buried in archives does indeed come to light, which calls the original attribution into question, or that information that actually exists is known only to an extremely limited circle of highly specialized experts, who, however, do not attach great importance to this information and therefore do not publish it.
In its ten years of existence, Placart has never had to reverse the sale of a work—for example, due to an incorrect attribution. On the contrary: Thanks to our expertise and research, we have on several occasions been able to clarify or even correct attributions, dates, and information on printing techniques—even those provided by recognized experts.
6. There is No right to return or exchange. The seller answers all questions regarding authenticity and condition truthfully and provides prospective buyers who have never seen the work in question with their own eyes with high-quality digital images. This ensures that the buyer is, in the truest sense of the word, “in the picture” regarding all the characteristics of the purchased work—while being aware that the works offered by Placart are, for the most part, delicate works on paper that have almost never survived the decades unscathed.
Exceptions to the exclusion of the right of return include the cases described in Section 5, as well as any agreements to the contrary made at the time the contract was concluded.
7. In the event of a Shipping The seller will carefully package the purchased item and ship it well-protected. The seller is not liable for damage caused by improper handling during transport and/or by customs.
8. The following applies exclusively: Swiss law; The place of jurisdiction is Zurich.
